<p style="text-indent: 2em;">张华将其承包的位于北京市朝阳区的一处工程中的部分工程转包给李明，李明按照约定完工后，张华迟迟未给李明结算工程款。于是李明以建设工程施工合同纠纷为案由将张华诉至北京市平谷区人民法院。张华收到起诉状后，提交了答辩状，到庭应诉。请问平谷法院是否可以管辖该案？</p> 
<p style="text-indent: 2em;">答：</p> 
<p style="text-indent: 2em;">《中华人民共和国民事诉讼法》第127条规定：人民法院受理案件后，当事人对管辖权有异议的，应当在提交答辩状期间提出。人民法院对当事人提出的异议，应当审查。异议成立的，裁定将案件移送有管辖权的人民法院；异议不成立的，裁定驳回。</p> 
<p style="text-indent: 2em;">当事人未提出管辖异议，并应诉答辩的，视为受诉人民法院有管辖权，但违反级别管辖和专属管辖规定的除外。</p> 
<p style="text-indent: 2em;">《中华人民共和国民事诉讼法》第33条规定：下列案件，由本条规定的人民法院专属管辖：</p> 
<p style="text-indent: 2em;">（一）&nbsp;因不动产纠纷提起的诉讼，由不动产所在地人民法院管辖；</p> 
<p style="text-indent: 2em;">（二）&nbsp;因港口作业中发生纠纷提起的诉讼，由港口所在地人民法院管辖；</p> 
<p style="text-indent: 2em;">（三）&nbsp;因继承遗产纠纷提起的诉讼，由被继承人死亡时<span style="text-indent: 2em;">住所地或者主要遗产所在地人民法院管辖。</span></p> 
<p style="text-indent: 2em;"><span style="text-indent: 2em;">《最高人民法院关于适用</span><span style="text-indent: 2em;">  的解释》第二十八条规定：民事诉讼法第三十三条第一项规定的不动产纠纷是指因不动产的权利确认、分割、相邻关系等引起的物权纠纷。 </span></p> 
<p style="text-indent: 2em;">农村土地承包经营合同纠纷、房屋租赁合同纠纷、建设工程施工合同纠纷、政策性房屋买卖合同纠纷，按照不动产纠纷确定管辖。</p> 
<p style="text-indent: 2em;">不动产已登记的，以不动产登记簿记载的所在地为不动产所在地；不动产未登记的，以不动产实际所在地为不动产所在地。</p> 
<p style="text-indent: 2em;">本案中，建设工程施工合同纠纷案件属于不动产纠纷，应适用专属管辖的相关规定，不适用应诉管辖。因涉案工程实际所在地为北京市朝阳区，故本案应由北京市朝阳区人民法院管辖，北京市平谷区人民法院对本案无管辖权。</p>
