'<p style="text-indent: 2em;">问：</p> 
<p style="text-indent: 2em;">王某前年因丈夫高某有外遇而离婚，双方婚生子高小某归王某抚养。王某对高某心存怨气，故在离婚后将高小某的姓名改为“王小某”。高某以此为由，认为“王小某”已经不与自己同姓，所以拒不给付“王小某”的抚养费。想问的是，离婚后与孩子共同生活的一方，有权利给孩子该姓吗？不与孩子共同生活的一方，能否以孩子已经“改姓“为由，拒不给付孩子的抚养费用？</p> 
<p style="text-indent: 2em;">答：</p> 
<p style="text-indent: 2em;">1、我国《婚姻法》第二十二条规定：“子女可以随父姓，可以随母姓。”</p> 
<p style="text-indent: 2em;">父母离婚后，父母子女关系依然存在，即便孩子改随他姓，这种父母子女关系也没有发生变化，父亲对改姓后的孩子仍然负有抚养义务。最高人民法院1993年11月发布的《关于人民法院审理离婚案件处理子女抚养问题的若干具体意见》第十九条规定：“父母不得因子女变更姓氏而拒付子女抚育费。”根据上述规定，孩子改姓后，父亲或母亲应该继续支付抚养费，不得以孩子已经改姓为由抗辩。该条同时规定，父或母一方擅自将子女姓氏改为继母或继父姓氏而引起纠纷的，应责令恢复原姓氏。但这必须以诉讼为前提。</p> 
<p style="text-indent: 2em;">因此，离婚后与孩子共同生活的一方，未征得另一方同意时，无权单独改变孩子姓名。如果一方未经另一方同意擅自改变孩子姓名，另一方可以到法院诉讼，要求法院责令恢复子女原姓名。</p> 
<p style="text-indent: 2em;">2、我国《婚姻法》第三十六条第一款规定：“父母子女间的关系，不因父母离婚而消除。离婚后，子女无论由父或母直接抚养，仍是父母双方的子女。”</p> 
<p style="text-indent: 2em;">《婚姻法》第三十七条第一款规定：“离婚后，一方抚养的子女，另一方应负担必要的生活费和教育费的一部或全部，负担费的多少和期限的长短，由双方协议；协议不成时，由人民法院判决。”</p> 
<p style="text-indent: 2em;">《婚姻法》第三十七条第二款规定：“关于子女生活费和教育费的协议或判决，不妨碍子女在必要时向父母任何一方提出超过协议或判决原定数额的合理要求。”</p> 
<p style="text-indent: 2em;">根据上述规定可知，无论孩子跟母姓，还是随父姓，父母任何一方都有抚养未成年子女的义务，不能以孩子的姓发生改变为由而拒不给付孩子的抚养费。如果一方拒不给付孩子的抚养费，与未成年子女共同生活的一方可以与另一方先行协商，协商不成的，可以起诉要求另一方支付孩子的抚养费。</p>
